Sutter O’Connell Secures Dismissal in Ohio Supreme Court on Behalf of Lorain County Prosecutor

Sutter O’Connell Shareholder Rob Cahill obtained a dismissal for the Lorain County Prosecutor in the Ohio Supreme Court in a mandamus and taxpayer action brought by a candidate seeking to compel the Prosecutor’s Office to investigate alleged voter fraud in a 2015 city council election in the City of Lorain.  The Court granted a Motion for Judgment on the Pleadings, which compellingly demonstrated that 1. the mandamus action failed because the Prosecutor’s Office fulfilled all of its prescribed legal duties and 2. the taxpayer claims failed because they did not seek to protect public funds.
