Jay brings over 20 years of litigation experience to Sutter O’Connell. He focuses his practice in the areas of Commercial Litigation and Labor and Employment Litigation. Jay has experience handling all kinds of employment and commercial disputes, including restrictive covenants, non-solicitation/non-disclosure agreements, corporate raiding, unfair competition, non-competition agreements, misappropriation of trade secret claims, and tortious conduct in commercial settings. He has extensive first-chair trial experience in numerous Federal and state courts, in addition to many mediation and arbitration proceedings through the American Arbitration Association and other alternative dispute panels and tribunals

Representative Matters

  • Successful defense of a steel-belt conveyor system manufacturer and its new employee in the United States District Court for the Northern District of Ohio against claims for breach of a non-compete agreement, misappropriation of trade secrets, and conversion claims; resulting in the new employee and the client to remain in business and in the same industry segment as plaintiff.
  • Represented a national financial institution in enforcing its employment agreements and mandatory arbitration provisions therein via court litigation; resulting in successful defense of sexual harassment, age discrimination, pregnancy discrimination, and religious discrimination claims before the American Arbitration.
  • Obtained favorable verdict after a two-week jury trial in favor of a large multi-state professional service firm against claims asserted by an architectural firm relating to the build-out of a new Class A commercial space in Cleveland, Ohio.
  • Represented a nation-wide restaurant franchisor in Summit County Common Pleas Court, obtaining a judgment in favor of the client in the form of a permanent injunction (and money damages) shutting down a non-compliant franchisee in violation of various provision of the parties' franchise agreement
